Revised timeline for the Extended Producer Responsibility for Packaging – Updated on 12/10/2023 and 01/07/2024

The Ministry of Environment has revised the timeline for implementing the Extended Producer Responsibility for Packaging. Initially, the date was changed from January 1st, 2025, to July 1st, 2025. Now, the date for full implementation of the Extended Producer Responsibility for Packaging has been changed again, this time to October 1st, 2025. The start date for company registration and reporting of the expected amounts of packaging to be marketed remains unchanged from the most recent timeline update, with the deadline still set for August 31, 2024. The article was updated again on July 1st, 2024, where we revised the new date for the full implementation of the Extended Producer Responsibility for Packaging.

With the first update of the timeline the implementation of the Extended Producer Responsibility for Packaging was delayed by six months. With the latest update, implementation has been pushed back another three months.

The new implementation date for the Extended Producer Responsibility for Packaging is now October 1st, 2025.

REPORTING EXPECTED QUANTITIES IN 2024

The current schedule for reporting expected packaging quantities put on market for 2024 remains unchanged.

Ahead of the implementation of the Extended Producer Responsibility for Packaging in 2025, companies covered by the Extended Producer Responsibility must register with the DPA and report the quantities of packaging they expect to market in 2024. According to the original timeline, these registrations were supposed to take place from January 1st, 2024, to March 31st, 2024. The starting date for reporting was later changed to April 1st, 2024. The deadline for reporting expected packaging quantities for 2024 remains to be August 31st, 2024, as per the updated timeline.

WHY IS THE TIMELINE CHANGING?

Several EU countries have already implemented the Extended Producer Responsibility for Packaging – in fact, Denmark is one of the last countries to do so.

The EU aims to harmonize the handling of producer responsibilities across member states, which is why they developed the Packaging Regulation. This regulation was under negotiation in the EU, and during these negotiations, a standstill period was in effect.

The standstill period extended until May 9, 2024, and impacted Denmark’s implementation of the Extended Producer Responsibility for packaging. We cannot draft Danish legislation on packaging until the EU law upon which our national law is based is finalized.

Therefore, Denmark cannot enact new national legislation on the Extended Producer Responsibility for Packaging until the standstill period ends, making it very challenging to maintain the original implementation timeline.

As a result, the initial adjustments to the Danish timeline were made to align it with the EU’s new Packaging Regulation.

According to the Ministry of Environment, the reason for moving the implementation date for a second time is to allow for a transitional period where municipalities and producers have the opportunity to learn and adapt to the rules of the Extended Producer Responsibility.
